2. Scope
These Terms of Use apply to the use of the app Bearhugme, internationally branded from the German app Drück mich, and all related services. By registering for or using the app, you agree to these terms.
3. Service description
Bearhugme is an app for daily check-ins. The app:
- lets a user send a daily sign that they are okay
- notifies trusted contacts if a check-in is missed
- connects users with people they trust
- can remind users about their daily check-in through push notifications
4. Registration and account
The basic app can be used without a traditional account registration. The app uses a device-based ID stored locally on the device. A verified email address is required when you add trusted contacts, because it identifies you and enables account linking. The email address can also be used to recover your account on a new device.
5. Cost and subscription
Free use
The core features of the app — the daily check-in, the status view of your Lieblingsmenschen, and the missed-check-in alert — are free to use and remain free after a Premium subscription is introduced.
Premium subscription
In addition to the free core features, we offer an optional Premium subscription. The billing period (monthly or annual) and the current price are shown to you before purchase, in the app and in the relevant app store; the price shown there is binding.
The subscription renews automatically for the chosen billing period unless you cancel beforehand. Cancellation happens through your app store account (Apple App Store or Google Play), not in the app itself — a link is available in the app's settings under "Manage subscription". Billing, cancellation, and refunds are handled exclusively by the relevant app store; its terms additionally apply.
Right of withdrawal (EU consumers)
If you are a consumer in the EU, you generally have a 14-day right of withdrawal. Because the Premium subscription is digital content not supplied on a physical medium, this right ends early once performance of the contract has begun, provided you expressly agreed during the purchase flow in the relevant app store that performance begins before the withdrawal period ends, and acknowledged that you thereby lose your right of withdrawal.
6. Availability
We try to keep the app highly available, but we do not guarantee uninterrupted use.
7. Liability disclaimer
We are not liable for:
- damage caused by a missing, delayed, or undelivered notification
- technical failures at third-party providers such as Supabase, Railway, Amazon SES, Apple, Google, or RevenueCat
- damage caused by using the app as a substitute for emergency services, medical care, or professional support
8. User obligations
You agree to:
- not use the app for unlawful purposes
- not enter false contact details
- not misuse the app to harass, pressure, or monitor another person
9. Termination and account deletion
You can delete your account at any time in the app settings. After deletion, your data is removed within 30 days unless legal retention obligations apply.
10. Changes to these terms
We may update these Terms of Use. For material changes, we will inform users in the app where appropriate. Continuing to use the app after changes take effect means you accept the updated terms.
11. Applicable law
The law of the Federal Republic of Germany applies. The place of jurisdiction is Berlin where legally permitted.
